Why the restrictions exist

Three regulatory reasons:

  • Exchange licensing:Bybit, Binance (global), Kraken Futures, and most other global crypto exchanges don't hold US state licenses. A prop firm routing to these exchanges inherits the restriction.
  • CFTC and state-level regulation: US crypto derivatives regulation is fragmented. CME-listed crypto futures (Bitcoin, Ether) are legally clean. OTC CFDs are restricted for retail in most states.
  • Payment rails: Some firms find it operationally expensive to onboard US customers due to KYC requirements, tax reporting (1099 forms), and bank rail friction. They exclude US residents to simplify.
